Article 1: Object

The purpose of these Terms of Use (hereafter ‘TOU’) is to define the conditions and clauses according to which the International College of Aesthetic Medicine (hereafter ‘CIME’) provides Users with access to the Website www.cime-paris.fr (hereafter the ‘Website’). They also stipulate the terms of access to and use of the Student Account by the Student

 

Article 2: General provisions

(2.1) Access to and use of the Website www.cime-paris.fr and the Student Account imply full unreserved acceptance of these TOU.

(2.2) The User shall use the Website in compliance with applicable legislation and these TOU. Any use which is fraudulent, improper or in breach of the rules defined by the Publisher and the CIME may result in restrictive action including the suspension or removal of access to Website.

(2.3) The Student shall use the Website and Student Account in compliance with applicable legislation and these TOU. (2.4) Unless stipulated otherwise, the terms and expressions used in these TOU shall carry the meaning attributed to them in the Terms of Sale (hereafter ‘TOS’) and the Confidentiality Policy. Within these TOU, any reference to the TOS and the Confidentiality Policy shall apply to the applicable documents available on the Website (TOS: [lien]/Confidentiality Policy: [lien]) or upon request, by any means of communication, from the CIME:

Article 3 – Definitions 

For the purposes of these TOU, the following terms and expressions shall carry the following meanings and apply to both singular and plural forms depending on the context. Similarly, any grammatical reference to the masculine or feminine gender [in the French language] shall include the other, unless stipulated otherwise.

  • Student Account’: designates the area accessible from the Website, which is strictly personal, secure and reserved for the Student, protected by a personal, non-transferable password. It provides access to, in particular, Theory Training

 

  • Terms of Sale’ (TOS): designate the terms applicable to Training. Inform the Student about the terms for carrying out Training services provided by the CIME; describe the rights and obligations of both Parties; cover commercial relations.

 

  • Terms of Use’ (TOU): designate all contractual rules defining the rights and obligations of the Parties in the context of access to and use of the Website and the Student Account. In particular, they cover the terms of use of content and functions, User, Student and Publisher responsibilities, including restrictions of use.

 

  • Content’: designates all elements, data, information and media accessible on the Website and on the Student Account, provided by the Publisher, the CIME, Users, Students or third parties. This includes, without being limited to, texts, articles, comments and publications, including images, graphics, logos and illustrations. It also includes training content, videos, audio files and podcasts, including the services and functions proposed on the Website and the Student Account. Technical and software architecture, including databases, software, scripts, source codes and interactive interfaces, is also part of Content. Unless stipulated otherwise, Content is protected by intellectual property laws and may not be reproduced, amended or used without authorization from the CIME, Publisher and its partners or within the limits as stipulated by law.

 

  • Data Protection Officer’: designates the person responsible for ensuring personal data processing compliance carried out by the CIME, in compliance with General Data Protection Regulations (GDPR) and applicable French legislation. They inform and advise Processing Managers and Subcontractors, ensuring legal and regulatory obligations are met and is the principal point of contact for any question on Personal Data protection, including for exercising the rights of those concerned.

 

  • Personal data’: designates any information referring to an identified or identifiable individual entity directly or indirectly, in particular through an identifier such as a name, ID number, location data, online username or one or more elements to their physical, physiological, genetic, psychological, economic, cultural or social identity. Personal Data processing is managed by the Confidentiality Policy, in compliance with the GDPR.

 

  • Publisher’: designates the corporate entity, subcontracted by the CIME, owner of the Website, responsible for the design, administration, management and online publication of the Website and Student Account. The Publisher ensures the functioning of the Website and Student Account, Content availability and compliance with applicable legal and regulatory obligations.

 

  • Student’: designates the doctor in medicine, surgery or dentistry, or intern in medicine, surgery or dentistry, registered for Training with the CIME. The Student acknowledges that the use of certain Website and Student Account functions may require Personal Data to be provided and processed in compliance with the Confidentiality Policy.

 

  • Purpose’: designates the specific, clear and legitimate objective for which personal data are collected and processed by the CIME. In compliance with the GDPR, data may be processed as part of the Purposes determined when they are collected and may not be used subsequently in a way that does not comply with these Purposes.

 

  • Training’: designates the Theory Training modules and the Practical Training

 

  • Theory Training’: accessible in the Student Account, on the Website, designates training content including, and not limited to, written training materials, videos, knowledge assessment surveys, syllabuses etc. Access to Theory Training requires prior Registration as defined in the TOS.

 

  • Host’: designates the individual or corporate entity subcontracted by the CIME to host data, Website Content and the Student Accounts. The Host ensures the maintenance and accessibility of the Website and Student Accounts and that they go online, guaranteeing compliance with legal requirements in terms of data protection and security.

 

  • Registration’: designates the process (Cf. Art.4 of the TOS) according to which the Student registers with the CIME.

 

  • Party’: as defined in (1.3) of the TOS.

 

  • Confidentiality Policy’: designates the document intended to provide Users and Students with clear, transparent and accessible information on how their Personal Data are collected, processed, stored and protected in the utilization of the Website and/or services offered. It specifies the types of data likely to be collected (including identity, contact details or browsing data), the Purposes and legal bases justifying this processing, in particular consent, contractual performance or legitimate interest of the Processing Manager. The Confidentiality Policy also lists the data retention period, potential recipients, User and Student rights and how these rights are exercised. Finally, it stipulates the security measures taken to ensure the confidentiality, integrity and protection of personal data. It is drawn up in compliance with French law n°78-17 of January 6, 1978 amended on IT, files and freedoms, including Regulation (EU) 2016/679 of April 27, 2016 (GDPR).

 

  • Processing Manager’: designates the individual or corporate entity who determines the Purposes and processing methods for Personal Data. As part of the Training offered by the CIME, the Processing Manager is responsible for ensuring Personal Data processing compliance with the GDPR and applicable French legislation, in particular in terms of transparency, security and respect for the rights of those concerned.

 

  • ‘General Data Protection Regulations’ (GDPR): designates the General Data Protection Regulations (GDPR), or Regulation (EU) 2016/679 of April 27, 2016, which are reference regulations for Personal Data protection within the European Union. It standardizes Personal Data processing throughout EU member states and applies to any public or private organization which collects or processes data concerning identifiable individual entities. In particular, the GDPR ensures Processing Managers and their Subcontractors guarantee the integrity, loyalty and transparency of processing, limit Personal Data collection to the strict necessary, ensure precision, security and confidentiality and respect the rights of those concerned. These rights include right of access, rectification, deletion, limitation, opposition and the right to the portability of data. The GDPR also ensures an obligation to document, inform and, in certain cases, designate a Data Protection Officer.

 

  • ‘Website’: designates all Content accessible via the URL [www.cime-paris.fr] and operated by the Publisher. The Website includes all the functions provided for Users and in particular access to the Student Account for Students. Unless stipulated otherwise, the Website is protected by intellectual property legislation and remains the sole property of the CIME, the Publisher and its partners.

 

  • ‘User’: designates any individual or corporate entity, accessing, browsing or using the Website in any way. The User acknowledges that the use of certain Website functions may require Personal Data to be provided and processed in compliance with the Confidentiality Policy.

 

Article 4 – Legal notices:

(4.1) The Website’s Host is the simplified Corporation (SAS) Com&Co Events, registered with the Registre du Commerce et des Sociétés (RCS) under number 528 558 125 with head offices at 15, Boulevard Grawitz in Marseille (13016).

Article 5 – WEBSITE AND STUDENT ACCOUNT ACCESS

(5.1) The objective of the Website is to inform the User about the CIME Training and enable Students to access their Student Account.

(5.2) The Website offers free access to any User with Internet access. All costs related to the Website, including material, software or Internet access costs are to be covered exclusively by the User. The User is solely responsible for their IT equipment and Internet access.

(5.3) The Student Account can be accessed, after Registration, by any Student with Internet access. All costs related to Student Account access including material, software or Internet access costs are to be covered exclusively by the student. The student is solely responsible for their IT equipment and Internet access.

(5.4) The CIME shall make every effort to ensure 24/7 Website and Student Account access, force majeure or event outside the CIME’s control notwithstanding, and subject to potential failures and/or maintenance interventions required for the Website and Student Accounts to function normally.

(5.5) As a result, the CIME cannot guarantee continuous availability of the Website and Student Accounts, nor the reliability of transmissions and performances in terms of response times or quality.

(5.6) No technical assistance shall be provided for the User, electronically, by phone or any other means. The Student can contact the CIME (Cf. 2.2) for technical assistance concerning access to their Student Account.

 

Article 6 – Data collection:

(6.1) In compliance with the General Data Protection Regulations (EU) 2016/679 of April 27, 2016 and French law n°78-17 of January 6, 1978 on IT, files and freedoms, the collection and processing of Personal Data required to create the Student Account, shall be carried out with respect for privacy.

(6.2) For Personal Data processing carried out in order to use the Website, the CIME takes on the role of Processing Manager with Users and Students.

(6.3) User and Student Personal Data are processed for Website use based on consent, contract performance or pre-contractual measures, or the legitimate interest of the CIME, when applicable.

(6.4) According to these same regulations, the User and Student have a right of access, rectification, deletion, portability, opposition and limitation over their Personal Data.

(6.7) The type of data, their Purposes and their retention period are indicated within the Confidentiality Policy accessible on the Website www.cime-paris.fr

 

Article 7 – Intellectual property:

(7.1) The CIME brand, general structure of the Website and Content are the property of the CIME, the Publisher and its partners.

(7.2) Any partial or total representation and/or reproduction and/or use of the Website Content and without the prior authorization of the CIME, the Publisher and their partners is strictly prohibited and would be liable to constitute counterfeiting according to articles L.335-2 et al of the French Code de la Propriété Intellectuelle.

(7.3) In addition, any partial or total representation and/or reproduction and/or use of the brand, Website and/or its content in any way is strictly prohibited.

 

Article 8 – Responsibility of the Publisher and the CIME

(8.1) The Publisher and the CIME make every effort to ensure a high-quality Website. However, they cannot be held responsible in the event of non-availability, failure, modification or error occurring during use of the Website.

(8.1.1) There can be no guarantee that the Website and its Content will be exempt from anomalies, errors or bugs, nor that it will operate without failure and without interruption.

(8.1.2) Similarly, absolute Website continuity, accessibility and security cannot be guaranteed on account of risks associated with Internet use.

(8.2) Information published on [www.cime-paris.fr] is presented purely for informational purposes only and has no contractual value.

(8.3) Despite regular updates, the Publisher and the CIME cannot be held responsible in the event of any modification to administrative and legal provisions occurring after publication. The same applies for using and interpreting information communicated on the Website.

(8.4) The Publisher and the CIME decline any responsibility for any viruses which may infect User or Student IT equipment following use of the Website or after access to the Student Account.

(8.5) The Publisher and the CIME cannot be held responsible in the event of a force majeure or any unforeseeable and insurmountable third-party event.

 

Article 9 – Student Responsibility

(9.1) The Student is aware of and fully responsible for any risks associated with using their username and password.

(9.2) The Student’s password must not be disclosed. In the event of any breach, the Publisher and the CIME decline any responsibility.

(9.3) The Student assumes full responsibility for how they use data on the Website and on their Student Account.


Article 10 – Hyperlinks 

(10.1) The Website and Student Account may contain links, in particular hyperlinks to other websites managed and published by third parties.

(10.2) By clicking on these links, the User and the Student leave the Website which has no control and can therefore not be held responsible for web content from these links.

 

Article 11 – Cookies:

(11.1) When visiting the Website and the Student Account, cookies may be installed automatically on the User or Student browser.

(11.2) Cookies are files temporarily saved on the User or Student’s hard disk required to ensure accessibility and browsing on the Website and Student Account. They do not contain any personal information and cannot be used to identify someone.

(11.3) The information contained in the cookies improves browsing performance on the Website [www.cime-paris.fr] and on the Student Account.

(11.4) If the User or Student who authorized the cookies then decides to disable them, this can be done in the browser settings.

 

 

Article 12 – Contract Duration

(12.1) This contract is valid for an unspecified period. The time Website services begin to be used marks the application of the contract with regard to the User.

(12.2) In the event these TOU are rejected, the User shall stop using all or part of the Website.

(12.3) Non-compliance with any obligation contained within these TOU shall lead to immediate termination of the contract between the CIME and the User, without prejudice to any damages for the CIME.

 

Article 13 – Applicable law and jurisdiction

(13.1) If one or more provisions of these TOU are nullified, illegal or non-invocable, in full or in part, according to legislation, this nullity, illegality or non-invocability shall not affect the validity, legality or invocability of the other provisions within these TOU, and any stipulation declared null shall be deemed dissociable from these TOU.

(13.2) These TOU are governed and interpreted according to French law. In the event the TOU are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of any dispute.

(13.2.1) The User or Student renounces any incompetence exception relative to subject matter jurisdiction or territorial jurisdiction of the court it may call upon to oppose the introduction of proceedings before these courts;

(13.2.2) The User or Student consents, insofar as authorized by applicable legislation, to the fact that taking proceedings before one or more jurisdictions does not prevent proceedings being taken before any other jurisdiction.

(13.3) In the event of any dispute concerning the performance, termination or conditions of these TOU, the Parties shall attempt to ensure an amicable agreement, where applicable, resorting to mediation. Any dispute not resolved through amicable proceedings, followed by mediation, will be exclusively brought before the court of competent jurisdiction of the CIME. By accepting these TOU, the Student acknowledges that they accept the entirety of this exclusive competence clause. Amicable negotiation and mediation (if the provisions of the Code de la Consommation apply) are therefore mandatory preconditions before referring the case to the court.

 

Article 14 – Other provisions

(14.1) These TOU are agreed upon between the CIME and the User or Student and are non-transferable.

(14.2) Each point is valid and independent of the others. The invalidity of a clause or part of these TOU shall not affect the validity of unaffected clauses.

(14.3) These TOU only are applicable for the Website and the Student Account and apply in their entirety.

(14.4) The CIME reserves the right to modify the clauses of these TOU at any time and without reason.
